Statutory Framework

The North Somerset Primary Care Trust (the Primary Care Trust) is a statutory body which came into existence on 1st April 2002 under The North Somerset Primary Care Trust (Establishment) Order 2002 No 895, (the Establishment Order).

The principal place of business of the Primary Care Trust is Castlewood, PO Box 237, Tickenham Road, Clevedon, North Somerset, BS21 9AX.

Primary Care Trusts (PCTs) are governed by Act of Parliament, mainly the National Health Service Act 1977 (NHS Act 1977), the National Health Service and Community Care Act 1990 (NHS & CC Act 1990) as amended by the Health Authorities Act 1995 and the Health Act 1999 and the Health and Social Care Act 2001.

Functions are conferred on PCTs by the Secretary of State for Health through the National Health Service Reform and Health Professions Act 2002.

As a statutory body, the PCT has specified powers to contract in its own name and to act as a corporate trustee. In the latter role it is accountable to the Charity Commission for those funds deemed to be charitable as well as to the Secretary of State for Health.

The PCT also has statutory powers under Section 28A of the NHS Act 1977, as amended by the Health Act 1999, to fund projects jointly planned with local authorities, voluntary organisations and other bodies.

PCTs are required to adopt Standing Orders for the regulation of its proceedings and business in accordance with the Primary Care Trusts (Membership, Procedure and Administration Arrangements) Regulations [SI 2000/89], the Primary Care Trusts (Membership, Procedure and Administration Arrangements) Amendment (No 2) (England) Regulations 2002 [SI 20002/557 and the Primary Care Trusts (Membership, Procedure and Administration Arrangements) Amendment (England) Regulations 2003 [SI 2003 No. 1616]. Such Standing Orders should take account of the National Health Service Reform and Health Care Professions Act 2002. The PCT must also adopt Standing Financial Instructions (SFI’s) as an integral part of Standing Orders setting out the responsibilities of individuals.
